I’m writing to respectfully ask you to support and agenda HB 339 / SB408, a bill that protects Florida's children by holding vaccine manufacturers accountable when they advertise vaccines in our state and those products cause harm. HB 339 and SB408 is based on a simple and fair principle: if a company profits by promoting a vaccine through paid advertising, it should also be responsible if that advertised product injures someone. This bill clearly defines “advertising” to include paid promotions across television, radio, print, the Internet, digital media, product placement, and paid influencer promotions. Just as importantly, HB 339 and SB408 make clear what this bill is not about. It does not restrict conversations between healthcare providers and patients, and it does not apply to written materials a provider gives directly to a patient. It also does not apply to posters or promotional items displayed in clinical settings. HB 339 and SB408 also establishes a clear path to justice when harm occurs. If a manufacturer advertises a vaccine in Florida and that vaccine causes harm or injury, the manufacturer can be held liable. Under the bill, an individual may bring an action within three years, and if they prevail, the court must award actual damages, court costs, and reasonable attorney fees. I urge you to put on the agenda HB 339 and SB408 and support moving it forward this session. Florida families deserve transparency and accountability, especially when powerful corporations use paid media campaigns to influence healthcare decisions.
