I am writing to urge you to strike section 47 in HB 433 and section 48 in SB 290. These provisions would expand Florida’s food libel law far beyond its original purpose and create a serious threat to free speech, transparency, and the public’s right to discuss food safety and health. Florida’s current law was meant to address knowingly false statements about perishable food products. The language proposed in these bills is vague and overly broad, and it could allow corporations to sue Floridians, journalists, public interest organizations or even myself for simply for sharing truthful information or opinions about food safety, nutrition, pesticides, additives, or production practices. This expansion would have a chilling effect on public discussion by making people afraid to speak up due to the risk of expensive litigation. This chilling effect will impact parents' ability to find information about food and how it may impact their child. A company losing sales after consumers learn facts and make informed choices is not defamation, it is the natural outcome of a free marketplace. Floridians deserve open access to information about the food we feed our families. These bills would shift accountability away from producers and punish citizens for participating in honest public debate. Please defend the First Amendment and protect transparency by removing section 47 in HB 433 and section 48 in SB 290 and protect Florida Families.
